What is Labour Market Impact Assessment (LMIA)?

The Labour Market Impact Assessment (LMIA) is a work permit category that is almost a certain pathway to permanent residence and finally citizenship and therefore commands very high demand amongst various Canadian immigration streams.

LMIA, as a process, determines the effect of offers of employment to foreign workers on the Canadian labor market and local workers.

Whenever a Canadian employer intends to offer a job to a foreign worker, it needs to justify that no Canadian citizen or PR qualifies for the job vacancy and the required skills, education and experience are so unique that they can be only be fulfilled by a foreign worker.

What is positive LMIA?

Every Canadian employer must procure positive LMIA document (formerly known as Labour Market Opinion – LMO) before they proceed with a job offer to a potential foreign hire.

The Employment and Social Development Canada (ESDC) is responsible for the process of assessing and verifying an offer of employment. This is primarily done to ensure that there is no negative impact on the Canadian labor market. Obtaining a positive LMIA has higher chances if it is located in major Canadian cities and specialized positions with high salary have brighter chances of a positive LMIA.

What are major LMIA types

The wages paid to the temporary foreign workers with respect to LMIA applications are benchmarked against the median wage paid in that province or territory according to the latest figures.

High-Wage Workers

Validation

If the wages paid are at or above the benchmark median wage the job is classified as high-wage.

Low-Wage Workers

Validation

Otherwise, if the wages offered are below the benchmark, they are classified as low-wage.

  • High-Wage Labour Market Impact Assessment applications must accompany transition plans from the employer that show strategies to gradually decrease reliance on foreign workers with concrete examples.
  • As an alternate, they must prove how they help temporary foreign worker become a permanent resident.
  • These transition plans are mandated to ensure that Canadian citizens and permanent residents are prioritized in the work force and Temporary Foreign Worker Program (TFWP) are not misused.

Low-Wage LMIA

Low-Wage-LMIA-
  • Employers, with an existing workforce of 10 or more employees, applying for Low-Wage LMIAs are subject to a low-wage temporary foreign worker to total workforce ratio of 10% max calculated for hours worked at each worksite.
  • No transition plans, however, are required from employers applying for low-wage LMIAs.
  • Certain sectors e.g. Accommodation and Food Services and Retail Trade are not allowed to apply for LMIA if the unemployment rate exceeds 6% in an economic region.

In order to hire temporary foreign workers to Canada under the LMIA, the employers must pay a processing fee of CAD$1,000 for each application for Labour Market Impact Assessment.

The employer launching the application for LMIA has to advertise the job across Canada using Canada Job Bank in addition to at least two other advertising platforms for a minimum duration of a month.  

Under-Represented Groups

Validation

The employers must ensure that the focus of the advertising is on the under-represented groups like First Nations or persons with disabilities.

No Layoffs

Validation

The employers applying for LMIA must acknowledge that they can neither cut the hours of Canadian workers working in the same positions as the temporary foreign worker nor they can lay-off any Canadian worker.

  • Once the selection process is complete, having completed the pre-requisite and mandatory requirements ex-ante, the Canadian employer must apply for Labour Market Impact Assessment (LMIA) to ESDC
  • A successful application results in a positive LMIA issued to the Canadian employer with the name of the Foreign National on the LMIA document
